By order dated 13 March 2023, the Bavarian Supreme Court announced the model claimant in the proceedings against EY Wirtschaftsprüfungsgesellschaft and published it in the register of claims. This marks the start of the capital investor model case and the deadline for filing claims in the model case begins to run.

6-month deadline for filing claims

Aggrieved WIRECARD investors have 6 months from the date of publication of the model claimant in the register of claims to register the losses from their WIRECARD investments for the proceedings. The application can only be made by a lawyer.
The pending test case offers all aggrieved Wirecard investors, whether private, professional or institutional investors, the opportunity to secure their claims for damages against the statute of limitations and to have important liability issues clarified at low cost. In the opinion of Dr Greger & Collegen, it does not matter whether the investment was made in Wirecard shares, reverse convertibles, derivatives, options or certificates.

"We can clearly recommend filing claims for damages in the test case through our law firm based here in Munich," says Dr Stephan Greger, lawyer and specialist lawyer for banking and capital markets law. "Our law firm has acted as one of the leading law firms for the aggrieved Wirecard investors from the very beginning. This enables our law firm to optimally represent their interests in the proceedings in Munich."

Affected Wirecard investors who would like to join the upcoming test case can register with the specialist law firm Dr Greger & Collegen. You can contact us quickly at the following e-mail address:

Munich, 15 March 2022 - The Munich I Regional Court is currently hearing more than 600 claims for damages brought by aggrieved Wirecard investors - primarily against the auditing firm EY. The auditors are accused of having certified Wirecard's falsified balance sheets over many years, thereby causing billions in financial losses to Wirecard investors.

Since the Wirecard scandal became known, the specialist law firm for banking and capital market law Dr Greger & Collegen has been campaigning for the rights of Wirecard investors. The law firm's community of interest of Wirecard victims includes over 4,000 investors. A large number of interested parties have already mandated the law firm to protect their rights. The focus is on the assertion of claims for damages against the auditing company EY, against which the law firm is already conducting a large number of proceedings before the courts in Munich.

In its latest decision dated 14 March 2022, the Munich Regional Court I referred the legal issues requiring clarification in the currently pending Wirecard damages proceedings to the Bavarian Supreme Court for a uniform review and decision. The capital investor model case ("KapMuG proceedings") now also provides those investors who have so far shied away from filing an individual lawsuit with a cost-effective way to establish in a legally binding manner whether the auditing firm EY can be accused of misconduct giving rise to damages in connection with its long-standing audits of Wirecard's financial statements and to avoid the impending statute of limitations on claims for damages.

The upcoming test case offers all aggrieved Wirecard investors, whether private, professional or institutional investors, the opportunity to secure their claims for damages against the statute of limitations at low cost and to have important liability issues clarified. It does not matter whether the investment was made in Wirecard shares, reverse convertible bonds, derivatives, options or certificates.

"We can clearly recommend filing claims for damages through our law firm based here in Munich," says Dr Stephan Greger, lawyer and specialist lawyer for banking and capital markets law. "Our investigations have shown that the auditors did not adequately fulfil their duties and can be accused of serious misconduct - in particular that they were extremely negligent in their duties and made false statements."
