Phishing: an increasingly sophisticated threat

Phishing is one of the most common and most dangerous forms of fraud in online banking. As a renowned law firm specialising in banking and capital market law, we would like to inform you about this threat and offer you assistance with legal questions.

Phishing attacks have developed into a highly professional threat that can affect anyone. Gone are the days when fake emails or text messages from banks were easy to recognise. Today's attacks on bank accounts are so sophisticated that they can fool even experienced users.

What is phishing?

Phishing is a scam in which criminals attempt to steal sensitive data such as bank access data or credit card information. This often happens through:

  • Fake e-mails that appear to come from your bank
  • Fraudulent websites that look deceptively similar to official banking portals
  • Manipulative telephone calls (so-called "vishing")

Recognising warning signals

Pay attention to:

  • Unusual sender addresses
  • Urgent requests
  • Suspicious links
  • Requests for sensitive data

Immediate measures in the event of suspected account compromise

If you suspect that fraudsters have gained access to your account, act immediately:

  • Account blocking: Contact your bank immediately to block the account.
  • Password change: Change all relevant passwords from a secure device.
  • Documentation: Save all suspicious messages and activities as evidence.
  • Report it: Inform the police and press charges.
  • Check: Check your account statements for unauthorised transactions.
  • Legal advice: Consult a specialised lawyer for further steps.

Law provides for reimbursement claim against the bank

The law stipulates that the bank must immediately refund the amount debited to the customer's account in the event of unauthorised payment transactions.

This has the great advantage that you do not have to follow the flow of money abroad, but can assert your claims locally.

The bank can only refuse a refund if its customer has either acted fraudulently or has facilitated the debit due to wilful intent or gross negligence.

Particularly in cases where bank customers were not forced to realise that they had entered their data on fake websites, there can hardly be any question of gross negligence.

If it is still possible to trace how the fraudsters spied out the account data, it is usually helpful to keep the Internet pages or e-mails when asserting claims for repayment with the bank.

You can quickly contact the phishing experts at the specialist law firm Dr Greger & Collegen by sending an e-mail to:

In particular, please tell us the bank concerned, the amount of your financial loss and any existing legal expenses insurance.
