* * * UPDATE 28 February 2020: PIM Gold creditors' meeting postponed * * *

Neither the insolvency court nor the insolvency administrator had expected such a large crowd: The crowd, which wanted to enter the community hall even an hour after the official start of the creditors' meeting in order to be able to take part in the creditors' meeting, did not stop. When no further creditors could be admitted to the hall for security reasons, it was announced to the great disappointment of the creditors, some of whom had travelled a long way, that the meeting would have to be moved to a new, larger venue. The aggrieved investors, who had hoped that the insolvency administrator Dr Metoja would bring light into the darkness, expressed their displeasure loudly.

The new date and venue is:

Stadthalle Langen, Südliche Ringstraße 77 in 63225 Langen.

On 1 December 2019, the Local Court of Offenbach am Main opened insolvency proceedings against the assets of PIM Gold GmbH due to insolvency and over-indebtedness (case no. 8 IN 402/19). Lawyer Dr Renald Metoja was appointed as the insolvency administrator. * * * UPDATE, 02.12.2019: INSOLVENCY PROCEEDINGS OPENED * * * On 1 December 2019, the Local Court of Offenbach am Main opened insolvency proceedings against the assets of PIM Gold GmbH due to insolvency and over-indebtedness (Ref. 8 IN 402/19). Lawyer Dr Renald Metoja was appointed as the insolvency administrator. Claims of the insolvency creditors must be filed with the insolvency administrator by 31 December 2019. The date for the creditors' meeting, at which a decision will be taken on the progress of the proceedings on the basis of a report by the insolvency administrator, is 28 February 2020, 10:00 a.m. in the building of the Offenbach am Main Local Court, Kaiserstr. 16-18, 63065 Offenbach am Main, Building K 16. UPDATE, 01.10.2019: Provisional insolvency proceedings opened 

On 30 September 2019, the Local Court of Offenbach am Main appointed Dr Renald Metoja as provisional insolvency administrator over the assets of PIM Gold GmbH (case no. 8 IN 402/19) and over the assets of the sales company "Premium Gold Deutschland GmbH" (case no. 8 IN 403/19). The provisional insolvency administrator will now examine the two companies in detail in order to gain a precise overview of the structure, business model and assets.

 UPDATE 28/09/2019: Insolvency application filed! 

As the Handelsblatt currently reports, both PIM Gold GmbH and the sales company Premium Gold Deutschland GmbH (PGD) have filed for insolvency at Offenbach Local Court since the beginning of last week. Both companies have therefore filed for insolvency themselves. The insolvency court is expected to decide on the two insolvency applications at the beginning of next week.

On Wednesday, 4 September 2019, documents and assets were seized at the business premises of PIM Gold GmbH and the managing partner Mesut P. was taken into custody. According to media reports, he allegedly gave customers gold as collateral for their investments, which was not available at PIM Gold GmbH at all. The reason given for his arrest was the risk of absconding. The Darmstadt public prosecutor's office is investigating commercial fraud, among other things.

According to rumours, around 1.9 tonnes of customer gold worth around EUR 82 million is missing. Hundreds of investors could be affected. Further investigations by the public prosecutor's office will show whether these allegations prove to be true. However, the measures taken on Wednesday already speak for themselves. This is because pre-trial detention can only be ordered if there is an urgent suspicion of an offence, which exists if there is a high probability that the accused will be convicted as a perpetrator or participant in a criminal offence based on the facts currently established.

"This is extremely worrying news for investors who have invested in gold stocks with PIM Gold," says Dr Stephan Greger, a specialist lawyer for banking and capital markets law. "But investors are not defenceless. It is now important to examine all options for asset protection. For example, the assertion of claims for damages against persons responsible for liability who were aware of irregularities or the immediate redemption by cancelling gold savings plans are also possible," continues lawyer Dr Greger. It is also important to constantly reassess the rights of investors in the event of new findings or legally relevant circumstances, such as insolvency. "In the event of insolvency, we take over the legally secure filing of claims," says Dr Greger.
